SOCIAL SECURITY DISABILITY BENEFITS: THE BASICS

When you or a loved one becomes disabled trying to navigate the Social Security Disability process can be overwhelming, intimidating and frustrating. Thus, it is helpful to know the basics of the process and when to obtain representation.

    When you or a loved one becomes disabled trying to navigate the Social Security Disability process can be overwhelming, intimidating and frustrating. Thus, it is helpful to know the basics of the process and when to obtain representation.

    There are five types of Disability benefits one can file for under the Social Security Disability Act:

    • Social Security Disability Insurance (SSDI). Social Security Disability Insurance benefits are received by a disabled worker, based upon one's work credits and insured status, and in some cases their dependents can received benefits.
    • Supplemental Security Income (SSI). Supplement Security Income benefits are received by adults and children who are disabled and who have income and resources below specified amounts.
    • Disabled Widow's and Widower's Benefits are paid to people who are at least 50 years old and who became disabled within a certain amount of time after the death of their spouse. The deceased spouse must have worked enough under Social Security to be insured.
    • Disabled Adult Children Benefits are paid to children of people who are deceased, disabled or retired under Social Security. The child must have become disabled before age 22.
    • SSI child's disability benefits are paid to children under the age of 18 who are disabled.

    Stages of Filing

    The Social Security Act provides a list of the types of impairments (disabilities) that are recognized. Social Security will look at ALL the disabilities an individual has, not just one.

    For example, if one has diabetes, COPD, and hypertension, all of these conditions will be taken into consideration.
    There are three stages for filing for disability benefits: 1. the Initial Application, 2. Request for Reconsideration, and 3. Request for Hearing. The Initial Application starts the process for filing for benefits. This can be done in person by going to your local Social Security Administration Office (NOT AVAILABLE DURING COVID), calling your local social security office and applying by phone or going online at www.ssa.gov. After filing your application contact legal representation to assist you at this stage. A decision will be rendered in approximately 3-5 months. If you are denied benefits, you have 60 days, from the date of the denial of your case, to file an appeal called a Request for Reconsideration. It is highly recommended that at this level you obtain representation to help you pursue your case. Updated medical information should be submitted to the Social Security Administration. A decision at this level takes approximately 7-9 months.

    If you are denied benefits at the Reconsideration level, you have 60 days, from the date of the denial letter, to file a Request for a Hearing before an Administrative Law Judge. It is strongly recommended that you seek representation at this level. It takes several months to obtain a hearing date. Once a hearing date is scheduled you will go before a Judge and provide testimony regarding you disabilities and how they affect your activities of daily living and your ability to work. It takes approximately 60-90 days to obtain a decision from the Judge. If you are denied benefits, you have 60 days, from the date of the denial, file an appeal to the Appeals Council. Again, it is highly recommended you obtain legal representation to file the Request for Hearing before a Judge as such attorney can make a determination as to whether you have a basis to appeal a Judge's denial decision to the Appeals Council.

    1. WHEN SHOULD I APPLY FOR SOCIAL SECURITY DISABILTY BENEFITS?

    You should apply for Social Security disability benefits as soon as possible after you become disabled and unable to work. You do not need to wait 12 months to apply, your disability need only be expected to last for at least one year or will result in death during that year.


    2. HOW DO I APPLY FOR SOCIAL SECURITY DISABILTY BENEFITS?

    You can fill out an application for Social Security Disability benefits at the local Social Security office nearest to your home (NOT AVAILABLE DURING COVID), online or by telephone. Go to ssa.gov, click on 'Disability' to apply for Social Security Disability Insurance (SSDI) benefits or click on 'SSI' to apply for both Supplemental Security Income (SSI) and SSDI benefits and follow the prompts to apply for these benefits.     When applying be prepared to give Social Security a list of the phones number and addresses of all doctors, hospitals, clinics you have treated with for your condition, a list of the current medications you are taking, and the places you have worked in the past 15 years.

    Other documentation you may need to provide include an original or certified birth certificate, your last earnings document (W-2, last pay stub, etc.) and copies (keep originals) of any medical records you may be able to obtain.
    Do not delay in filing for these benefits if you do not have these documents immediately available, they can be provided at a later date.


    3. WHAT TO DO IF I AM DENIED BENEFITS?

If you miss this deadline you may have to start over if Social Security does not find a good cause for a late filing of the appeal. The Social Security disability process can be overwhelming and frustrating, however, not filing an appeal will only set you back.
